GENERAL TERMS AND CONDITIONS OF SALE
1. SELLER IDENTIFICATION
The website www.atelieraelis.ma is operated by:
ATELIER AELIS, a single-member limited liability company (SARL AU) with a share capital of MAD 10,000, whose registered office is located at 105, corner of Mostafa El Maani Street and 11 Janvier Street, 3rd floor, Apartment 16, Casablanca, Morocco, registered with the Casablanca Trade Register under number 688801.

ATELIER AELIS is hereinafter referred to as “AELIS” or the “Seller”.
These General Terms and Conditions of Sale (“Terms and Conditions”) govern sales made through the website www.atelieraelis.ma between AELIS and any individual making a purchase for personal, non-professional purposes, hereinafter referred to as the “Customer”.
These Terms and Conditions are notably governed by Moroccan Law No. 31-08 establishing consumer protection measures.
2. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
Any order placed on the Website implies that the Customer has read and unconditionally accepted these Terms and Conditions.
The applicable Terms and Conditions are those in force on the date the order is placed.
AELIS reserves the right to amend these Terms and Conditions at any time. Any amendment will apply only to orders placed after its publication on the Website.
3. PRODUCTS
AELIS offers, among other things, textile accessories and handmade products.
The essential characteristics of each product are described on its product page.
AELIS takes the greatest possible care in presenting product photographs, descriptions and information. However, photographs are provided for illustrative purposes only.
Slight differences in colour, pattern, print placement or finish may occur depending on the screen used or as a result of the handmade nature of certain products.
Such slight variations do not, in themselves, constitute a product defect.
4. PRODUCT AVAILABILITY
Products are offered subject to availability.
If a product becomes unavailable after an order has been confirmed, AELIS will inform the Customer as soon as possible.
Where an order cannot be fulfilled due to a product being unavailable, any amounts paid for the unavailable product will be refunded in accordance with applicable legal provisions.
AELIS also reserves the right to limit the quantities that may be ordered where circumstances justify doing so.
5. ORDERS
The Customer selects the products they wish to purchase and adds them to their shopping cart.
Before finally confirming the order, the Customer may review the details of the order, the total price, any applicable delivery charges and make changes to their cart.
The Customer undertakes to provide accurate and complete information, particularly with regard to their identity, contact details and delivery address.
Confirming the order constitutes acceptance of these Terms and Conditions and creates an obligation to pay.
Once the order has been confirmed, a confirmation email is sent to the email address provided by the Customer.
AELIS reserves the right to refuse or cancel an order, in particular in the event of suspected fraud, clearly incorrect information, a payment incident or a dispute relating to a previous order.
6. PRICES
The applicable prices are those displayed on the Website at the time the order is confirmed.
Prices are displayed in Moroccan dirhams (MAD), unless otherwise stated on the Website.
Any applicable delivery charges are indicated to the Customer before final confirmation of the order.
AELIS reserves the right to change its prices at any time. However, a price change cannot affect an order that has already been confirmed.
In the event of an obvious pricing error resulting, in particular, from a technical issue or data-entry error, AELIS may cancel the relevant order and refund any amounts already paid by the Customer.
7. PAYMENT
The available payment methods are those offered to the Customer when confirming their order.
Card payments made on the Website are processed through the Payzone payment solution.
Banking information required to process the transaction is transmitted to the payment service provider as part of the secure payment process.
AELIS does not store the Customer’s complete payment card details.
The order may be suspended or cancelled if payment is refused by the banking institution or payment service provider.
The Customer guarantees that they have all necessary authorisations to use the selected payment method.
8. PAYMENT SECURITY
AELIS provides its Customers with secure payment methods through its payment service providers.
Card transactions made through Payzone may benefit from applicable security measures, including 3D Secure, depending on the card and banking institution concerned.
AELIS cannot be held liable for any refusal of authorisation by the Customer’s banking institution.
9. DELIVERY
Products are delivered to the address provided by the Customer when placing the order.
The Customer is responsible for ensuring that the information provided for delivery is accurate and complete.
Delivery areas, estimated delivery times and applicable delivery charges are indicated on the Website or during the checkout process.
Delivery times provided are estimates, subject to any mandatory provisions of applicable legislation.
In the event of any difficulty or delay relating to delivery, the Customer may contact AELIS at:
AELIS remains responsible to the consumer for the proper performance of the obligations arising from the distance sales contract in accordance with applicable regulations.
10. RECEIPT OF THE ORDER
Upon receipt of the order, the Customer is encouraged to check the condition of the parcel and that the products received conform to the order.
If a product is damaged, defective, missing or does not correspond to the order, the Customer is encouraged to contact AELIS as soon as possible at:
The Customer must provide their order number and any information or photographs enabling AELIS to identify the issue.
This procedure does not affect the Customer’s statutory rights.
11. RIGHT OF WITHDRAWAL
In accordance with Moroccan Law No. 31-08 on consumer protection, for distance contracts and where this right applies, the Customer has a period of seven (7) days from receipt of the product to exercise their right of withdrawal, without having to provide a reason for their decision.
To exercise this right, the Customer must clearly inform AELIS of their decision to withdraw by writing to:

The Customer must then return the relevant product(s) in accordance with the instructions provided by customer service.
Products must be returned complete and in a condition suitable for resale. The Customer is encouraged to take appropriate care of the products while they are in their possession.
Direct return costs resulting from a standard withdrawal are borne by the Customer, unless otherwise indicated by AELIS or required by mandatory legal provisions.
12. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with applicable legislation, the right of withdrawal may, in particular, not apply to goods made according to the Customer’s specifications or clearly personalised.
Accordingly, except in the event of a defect or non-conformity, products that have been specifically personalised at the Customer’s request cannot be returned under the right of withdrawal where the legal exception applies.
13. REFUND FOLLOWING WITHDRAWAL
Where the Customer validly exercises their right of withdrawal, AELIS will refund the amounts due in accordance with applicable legal provisions and no later than the statutory deadline following the exercise of the right of withdrawal.
Where possible, the refund will be made using the same payment method used for the original order, unless otherwise agreed with the Customer.
No additional fee will be charged to the Customer solely as a result of the refund.
14. DEFECTIVE OR NON-CONFORMING PRODUCTS
If a product received is defective or does not correspond to the order, the Customer must contact customer service at:
AELIS may request photographs or any information necessary to establish the defect or non-conformity.
After review, AELIS will offer, depending on the circumstances and applicable legal provisions, a replacement, repair where appropriate, or a refund.
Where a return is required due to a defect or an error attributable to AELIS, reasonable return shipping costs will not be borne by the Customer.
15. REFUNDS
Refunds approved by AELIS are made using the original payment method where technically possible.
The time required for the refund to appear in the Customer’s account may then depend on the banking institution or payment service provider.
This provision does not affect any refund deadlines imposed by applicable regulations.
16. INTELLECTUAL PROPERTY
All elements appearing on the Website, including photographs, illustrations, creations, texts, logos, trademarks, patterns, graphics, videos, visual elements, names and the Website design, are protected by applicable intellectual property laws.
Unless prior written authorisation has been obtained from AELIS, any reproduction, representation, adaptation, exploitation, distribution or use, whether total or partial, of these elements for commercial purposes is prohibited.
The AELIS / ATELIER AELIS brand, name and visual identity, as well as the creations belonging to AELIS, remain the exclusive property of their respective owners.
17. PERSONAL DATA
In connection with the use of the Website and the processing of orders, AELIS may collect certain personal data relating to the Customer, including their contact details, delivery information, order data and information required for payment.
This data is used, in particular, to:

18. LIABILITY
AELIS undertakes to fulfil the obligations arising from orders placed on the Website in accordance with applicable legislation.
Nothing in these Terms and Conditions shall have the effect of excluding or limiting any right granted to consumers by a mandatory provision of law.
However, AELIS cannot be held liable for damage resulting from improper use of the product by the Customer or from an event constituting force majeure under applicable Moroccan law.
19. FORCE MAJEURE
AELIS cannot be held liable for any delay or failure to perform resulting from an event recognised as force majeure under applicable legislation.
In such circumstances, AELIS will inform the Customer where possible and will take reasonable measures to limit the consequences of the event.

21. GOVERNING LAW AND DISPUTE RESOLUTION
These General Terms and Conditions of Sale are governed by Moroccan law.
In the event of any difficulty concerning the interpretation or performance of these Terms and Conditions, the Customer is encouraged to contact AELIS first in order to seek an amicable resolution.
If an amicable settlement cannot be reached, the dispute may be submitted to the competent courts in accordance with the jurisdiction rules provided for under applicable Moroccan legislation.
Nothing in these Terms and Conditions may have the effect of depriving a consumer of any mandatory protection or right granted to them by law.
22. SEVERABILITY
If any provision of these Terms and Conditions is declared invalid, unlawful or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
